ORDER:
The Director of Public Health and Family Welfare and Chief Registrar of Births
& Deaths AP, Hyderabad in his letter read above has stated that the Deputy Registrar General (CRS), New Delhi, India has informed that in the light of Supreme Court directions and recommendations of the CRS committee, all states / UTs were requested to open registration centers at the delivery centers such as Govt. Hospitals, CHCs /PHCs etc. to facilitate the Public to get Birth/Death certificates on the spot. He has further informed that the inspections under taken by the team of officers from Govt. of India, wherein it has come to the notice that in many States Non-GovernmentHospitals are also functioning as the registration units under Civil Registration System which is not correct and is the violation of provisions under Section 26 of the RBD Act,1969 wherein it is mentioned that “ Registrars and Sub – Registrars to be deemed public servants within the meaning of Indian Penal Code” i.e. only public servant could be appointed as Registrar or Sub Registrar, any employee of private hospital or Nursing home is not authorized to work as Registrar or Sub Registrar and could not be permitted to register any Birth /Death event and issued the certificates thereof. He has requested to initiate the action to amend the relevant Rule and ensure to open the Registration Units at delivery centers such as Government
Hospitals, and CHCs on priority basis so that registration centers should be opened without any further delay. Accordingly, the Director of Public Health and Family Welfare and Chief Registrar of Births & Deaths AP, Hyderabad has furnished the proposals for issue of necessary orders in the matter.
2. Government after careful examination of the matter in detailed and permitted the
Director of Public Health and Family Welfare and Chief Registrar of Births & Deaths AP, Hyderabad to open Registration Units of Civil Registration system under RBD Act, 1969 in the following delivery centers of Govt. Medical Institutions of the Govt. Hospitals, CHCs and PHCs etc in the State of Andhra Pradesh:
